Zillow wants RESPA case tossed for good

Zillow is again looking to shut down the renewed Real Estate Settlement Procedures Act (RESPA) claims filed against it in the combined Taylor-Armstrong lawsuit, but this time the company hopes it’s for good. On Tuesday, Zillow filed a motion to dismiss the Taylor-Armstrong suit with prejudice. In July, Judge James Robart of the U.S. District Court for the Western District of Washington granted Zillow’s previous motion to dismiss the lawsuit but gave the plaintiffs the opportunity to file a third amended complaint. If Robart grants Zillow’s motion to dismiss the suit with prejudice, the plaintiffs would not be able to refile their claims. In the filing, Zillow argues that the plaintiffs have yet to fix the deficiencies that Robart noted in his dismissal of the suit and that they have not alleged facts sufficient to support their RESPA or Washington Consumer Protection Act (WCPA) claims. “No amount of strategic repackaging can disguise the fundamental reality that Plaintiffs continue to assert the same claims, tied to the same pre-approval letters and related performance metrics, that the Court previously found could not support a claim,” the filing states.
