How the Delaware Transfer Tax is Calculated

Delaware’s transfer tax, known as a Real Estate Transfer Tax, is calculated at a rate of 3.0% of the property’s fair market value, divided equally between the buyer and seller. This rate may change depending on if the local municipality also charges a transfer tax.

Many counties and local governments also charge home sellers a real estate transfer tax. In Delaware, local municipalities can levy a tax of 1.5%. 

If the local transfer tax exceeds 1%, the state will reduce the state tax to 2.5%. This usually leads to a total transfer tax of 4%, split between the buyer and the seller.
