A crumbling Gold Coast beach shack has hit the market with an $8 million price tag and a rare town planning loophole that lets buyers bypass coastal red tape.

Set among a tightly held row of ramshackle originals on the Tugun shoreline, the 405 sqm deceased estate at 43 O’Connor St is for sale for the first time in more than 70 years, offering the chance to build a luxury mansion right on the water’s edge.

Purchased by the same family for a mere £2,500 in the 1950s, the salt-battered property is listed via an expressions of interest campaign with Amir Prestige agent Ross Tomain.

The beloved holiday home bears the heavy toll of its incredible position. Its exterior is eroded by decades of sea spray, while upstairs, a makeshift beam prevents the ceiling from caving in.

But the decrepit shack’s days are numbered. Beyond the obvious appeal of walking straight onto the sand, the site’s true value lies in the dirt.

Unlike modern coastal developments hamstrung by stringent council setbacks that push new homes further back from the dune line, this southern Queensland block operates under different rules.

Because the original shack and its immediate neighbours were built so close to the sand decades ago, a new buyer can capitalise on “exceptional proximity allowances to the beachfront boundary” using the existing footprint as a precedent.

Mr Tomain noted in the listing this historic quirk granted the buyer “more favourable planning conditions than many surrounding beachfront locations, allowing genuine architectural freedom.”

It means an owner-occupier can design a sprawling, contemporary masterpiece far closer to the water than would typically be permitted on a newly established site.

“[It’s] set directly on the sand in one of Tugun’s most tightly held beachfront streets — no road, no traffic, no separation,” Mr Tomain stated.

“From your lawn, it’s just metres to the shoreline. A privilege rarely available. It cannot be replicated, relocated or replaced.”

The O’Connor St pocket is also protected by strict 15m height limits to protect “light, views and the village character,” guaranteeing any future build won’t be plunged into the shadows of a towering high-rise.

“This will be more than a home,” Mr Tomain stated.

“It will be a generational beachfront holding, a finite piece of coastline and it is a once-in-a-lifetime opportunity.”

PropTrack data shows home prices in Tugun were up 8.8 per cent over the past 12 months to a median of $1.48m.
