Former Surfing Queensland CEO Adam Yates is selling his 1960s Gold Coast beach cottage currently at the centre of a court battle.

Mr Yates, who is taking the property to auction this month, had planned to knock down the old shack and develop luxury villas on the site at 23 Surf St, Mermaid Beach.

“A development application (DA) has been approved by Council which allows two beautiful villas to be built on the property, however the property is being sold as is with no DA attached,” said Mr Yates, who recently resigned from Surfing Queensland after being temporarily stood down amid a workplace investigation.

“The proposed luxury villas give buyers an insight into what could be possible and present a unique opportunity for growth and improvement in the area.

The villas were approved by the Gold Coast City Council in August, 2023.

Neighbours launched legal action in the Planning and Environment Court challenging the Council’s approval of the project.

“In this case, I obtained development approval for two luxury villas,” Mr Yates said.

“While one of the neighbours are currently appealing Council’s approved decision, people are awakening to the reality that development and redevelopment are a part of life.”

REIQ CEO Antonia Mercorella said it was “in the best interest of sellers to disclose any development approvals and any legal proceedings associated with sites for sale, as this could be considered a material matter to the buyer”.

“If a seller breaches this warranty, the buyer may have termination rights under the contract,” Ms Mercorella said.

Property records show Mr Yates bought the cottage for $1.9705m in April, 2021.

Real estate agent Carlie Mills of Amir Prestige Group is auctioning the property on September 21.

The two-bedroom one-bathroom weatherboard residence is on a 405sq m block with 12.5m of street frontage.

The kitchen is in original condition while the backyard also pays homage to a bygone era with a Hills Hoist clothesline.
